02 - Product Returns

2.1. Exercising the right of withdrawal
You have a right of withdrawal of fourteen (14) calendar days from the date of receipt or collection of your entire order.

During this period, you may return undamaged Products without having to provide any justification or pay any penalty. In the event of damaged Products received, the procedure outlined in Article 2.3 will apply.

All Products may be returned, except those excluded by law under Article L221-28 of the French Consumer Code, for example, Products that have been personalized at your request, Products that have been unsealed and cannot be returned for hygiene reasons (e.g., toilet seats, sanitary napkins, menstrual cups), etc.

Returned Products must be undamaged and complete and must not have been used.

To exercise your right of withdrawal, you can use the contact form on the website, making an unambiguous statement indicating your intention to return the Product to Salle d'ô.

Salle d'ô will acknowledge receipt of your withdrawal by email. You must then return the Products to Salle d'ô no later than fourteen (14) days following your withdrawal, either: - by mail to the following address: Salle d'ô, 48 grande rue Jean Moulin 34000 Montpellier. Return shipping costs via mail are your responsibility (except in the case of an error by Salle d'ô when sending the Product, in which case a return label will be provided). Salle d'ô is committed to refunding all sums paid upon receipt of the Product.

Salle d'ô will refund returned Products, subject to compliance with the conditions mentioned above, as well as the standard "outbound" delivery charges if you return your entire order. "Outbound" delivery charges with surcharges are refunded up to the amount of the standard delivery charges. Please note that the initial delivery charges will be refunded separately.

If you do not return your entire order and keep one or more of the ordered products, the initial delivery charges will not be refunded by Salle d'ô.

The refund will be issued via the payment method used for the returned order.

For any other payment method, or in the event of failure or impossibility of the above refunds, the refund will be issued by check sent to the billing address.

2.2. Exchange

You also have the option of requesting an exchange within thirty (30) days of receiving the Product.

You can return the Product to be exchanged to Salle d'ô by mail.

2.3. Special Case of a Non-Conforming Product
Salle d'ô advises you to check the Product upon delivery and, if the delivered Product is non-conforming (wrong Product, defective, damaged, or incomplete Product), to make written reservations no later than three (3) days following delivery, to the carrier and Salle d'ô.

In all cases, the provisions set forth in Article 8.1 concerning legal guarantees will apply. Thus, a non-conforming delivered Product will initially only be eligible for replacement or repair. However, if the new Product received is not suitable, you may exercise your right of withdrawal within the remaining period.

For Products reported as non-compliant within three (3) days of delivery, Salle d'ô nevertheless allows you to exercise your right of withdrawal and obtain a refund for the Product in accordance with the provisions of Article 7.1, without going through repair or replacement, as provided for by the legal guarantee of conformity.

3 - Guarantees

3.1. Legal Guarantees

All products sold on the website are covered by the legal guarantee of conformity (articles L217-1 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code), allowing you to return defective or non-conforming products.

You are hereby informed that the company Salle d'ô, whose registered office is at 48 Grande rue Jean Moulin in Montpellier, is the guarantor of the conformity of the Products to the contract within the framework of these two legal guarantees.

You have two years from the date of delivery of the Product to make a claim under the legal guarantee of conformity.
In this case, you may choose between repair or replacement of the Product, subject to the cost conditions stipulated in Article L217-9 of the French Consumer Code.
For contracts concluded on or after March 18, 2016, you are not required to provide proof of the existence of the Product's non-conformity during the twenty-four (24) months following delivery. For contracts concluded before this date, the defect is presumed for six (6) months.
Please note that the legal guarantee of conformity applies independently of any commercial guarantee that may be granted to you by the manufacturer or Salle d'ô.
Furthermore, you may choose to invoke the guarantee against hidden defects in the item sold, as defined in Article 1641 of the French Civil Code. In this case, you may choose between cancelling the sale or obtaining a reduction in the sale price in accordance with Article 1644 of the Civil Code.

- Article L217-4 of the Consumer Code: The seller must deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was the seller's responsibility under the contract or was carried out under the seller's supervision.

- Article L217-5 of the Consumer Code: Goods conform to the contract:
1. If they are fit for the purpose for which goods of the same type are normally used and, where applicable:
- if they correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
- if they possess the qualities that a buyer may legitimately expect, given the public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;

2. Or if they possess the characteristics defined by mutual agreement between the parties or are fit for any special purpose sought by the buyer, made known to the seller, and accepted by the seller.

- Article L217-12 of the Consumer Code: The action resulting from a lack of conformity is time-barred two years from the delivery of the goods.

- Article L217-16 of the Consumer Code: When the buyer requests the seller, during the term of the commercial warranty granted to them upon the purchase or repair of movable property, to carry out repairs covered by the warranty, any period of immobilization of at least seven days is added to the remaining term of the warranty. This period begins from the date of the buyer's request for service or the date the property in question is made available for repair, if this latter date is later than the request for service.

- Article 1641 of the Civil Code: The seller is bound by a warranty against hidden defects in the thing sold which render it unfit for its intended use, or which diminish that use to such an extent that the buyer would not have acquired it, or would have given only a lower price, if he had known of them.

- Article 1648, paragraph 1 of the Civil Code: The action resulting from latent defects must be brought by the buyer within two years of the discovery of the defect.

3.2. Commercial Guarantees

Some products may also be covered by a commercial warranty known as a "Manufacturer's Warranty," to which Salle d'ô is not a party. Therefore, Salle d'ô cannot be held liable if the manufacturer refuses to honor its warranty. The scope and duration of this warranty vary depending on the manufacturer. You can consult the exact terms of the warranties on the manufacturer's website and in the product's instruction manual.
